Newly-released bodycam footage from former Chicago Bears quarterback Jay Cutler’s DUI revealed he initially told law enforcement that he had not had anything to drink.
Police body camera footage obtained by TMZ shows Cutler, 42, speaking with police after he rear-ended another car while driving his truck in Franklin, Tennessee in 2024. While he ultimately admitted he had “a little bit” of alcohol in his system, he refused a field sobriety test. An officer subsequently handcuffed him and led him to a waiting police car.
Cutler — who shares three kids with ex-wife Kristin Cavallari — appeared to accompany the officer willingly, taking a seat in the back. Police told TMZ that Cutler was taken to the hospital for a blood draw, which showed a 0.23 blood-alcohol percentage, which is nearly three times the legal limit. He was then booked into the Williamson County Jail that night and later released on $5,000 bond.
One of the officers on the scene later said that he “noticed a strong odor of alcohol” on the Pro Bowler, according to a press release from the Franklin Police Department.
“Cutler was also slurring his words and had bloodshot eyes,” the release continued. “Cutler refused field sobriety tests and was taken to a local hospital where a blood sample was obtained through a blood search warrant.”
Cutler was arrested and charged with one count of misdemeanor DUI, gun possession while under the influence, violation of implied consent law and failure to exercise due care. He pleaded guilty to the DUI charge in August while prosecutors agreed to drop the other three charges as part of a plea deal.
A judge sentenced him to four days in jail, and ordered him to pay a $350 fine and attend DUI classes. He also had his license revoked for a period of time. Cutler completed his sentence in October and is under one year probation.
Cutler was back on his “Take it Outside” podcast days later on October 7 where he did not address the incident.
Perry Lee, the other driver involved in the collision, has since sued Cutler, saying Cutler was following his car at an unsafe distance, failed to maintain proper lookout and failed to pay attention. He also alleged that Cutler offered him $2,000 after the accident if he agreed not to call the police.
“Cutler failed to use reasonable and due care in the operation of the vehicle he was driving so as to avoid injury to other persons using the roadway, including [Lee],” read the suit, obtained by Us Weekly in September.
The lawsuit demanded unspecified damages as Lee argued he incurred medical bills and other expenses, along with physical and mental suffering and the loss of enjoyment of life.
“Our client is a veteran who was injured in a car crash due to the alleged negligence of another driver,” Lee’s lawyers John Morgan and attorney Sydney Pierce, told Us.
They added, “His injuries from the crash cause him daily pain and have eroded his quality of life. We are seeking justice for him so he can get the care he needs and try to move forward with his life.”
